Our Promise to You and Our Legal Obligations

The privacy of your health information is important to us. We are required by HIPAA, the HITECH Act, 42 CFR Part 2, and Montana law to protect the privacy and security of your Protected Health Information (PHI). We must provide you this Notice, follow its terms, and notify you if a breach occurs.

We reserve the right to change the terms of this Notice and make the revised Notice effective for all PHI we maintain.

 

How We May Use or Disclose Your Health Information


Treatment
We may use and disclose PHI to provide treatment, coordinate care, and consult with other healthcare providers.

Payment
We may use and disclose PHI to obtain payment from insurance companies and other third parties.

Healthcare Operations
We may use PHI for quality improvement, staff training, credentialing, licensing, compliance, audits, and business management.

Appointment Reminders and Communications
We may contact you via phone, voicemail, text message, email, postcard, or mail.

Disclosure to Family and Friends
We may disclose relevant PHI to family members or others involved in your care unless you object.

Business Associates
We may share PHI with Business Associates such as electronic health record providers, IT vendors, cloud storage providers, billing companies, and Heidi Health clinical documentation services. All Business Associates are required to safeguard PHI.

AI Clinical Documentation Disclosure
Frenchtown Dental uses Heidi Health, a HIPAA-compliant artificial intelligence clinical documentation system. Heidi operates under a Business Associate Agreement and complies with HIPAA privacy and security standards.

Minimum Necessary Standard
We limit PHI to the minimum necessary to accomplish the intended purpose of use, disclosure, or request.

Special Protections
Certain information, including substance use disorder information protected under 42 CFR Part 2, HIV-related information, mental health information, and genetic information, may receive additional protections.

Disclosures Required or Permitted by Law
We may disclose PHI for public health, abuse reporting, health oversight activities, judicial proceedings, law enforcement, research (when authorized), workers’ compensation, and to prevent serious threats to health or safety.

Your Rights Regarding Your Health Information
You have the right to access, inspect, obtain copies of, amend, restrict, and request confidential communications of your PHI; receive an accounting of disclosures; and receive breach notifications.

Right to Breach Notification
We will notify you without unreasonable delay and no later than sixty (60) days following discovery of a breach of unsecured PHI.

How to File a Complaint
If you believe your privacy rights have been violated, you may file a complaint with Frenchtown Dental or with the U.S. Department of Health and Human Services. We will not retaliate against you.
